Program Terms and Conditions

Effective Date: June 2026

These Terms and Conditions ('Terms') govern your participation in the 'Real Life with MyMoto' program ('Program') operated by MyMoto Pty Ltd (ABN 91 652 919 385)('MyMoto', 'we', 'us', 'our'), trading at mymoto.com.au. By submitting a Video Review, you agree to be bound by these Terms. Please read them carefully before participating.

1. Program Overview

The Real Life with MyMoto program invites eligible customers who have purchased a vehicle through the MyMoto Partner Network to submit a video review of their car.

2. Eligibility

  1. To be eligible to participate in the Program, you must:
    1. be at least 18 years of age at the time of submission;
    2. be a resident of Australia;
    3. have completed a vehicle purchase through the MyMoto Partner Network within the 12 months preceding your submission;
    4. submit your Video Review within 90 days of your vehicle purchase being finalised; and
    5. not be an employee, contractor, or director of MyMoto or any related entity.
  2. Only one (1) Video Review submission per vehicle purchase is permitted. Multiple submissions relating to the same vehicle purchase will be disqualified.

3. How to Participate

  1. To participate in the Program, eligible customers must:
    1. complete a vehicle purchase through through the MyMoto Partner Network;
    2. record a Video Review in accordance with the Video Guidelines set out in Section 4; and
    3. submit the Video Review via the method specified on the MyMoto website at the time of submission (which may include uploading via a dedicated portal, email, or other mechanism as directed).
  2. Submissions must be received before 11:59 PM AWST on the last day of the relevant calendar month to be included in that month's draw. Submissions received after this time will be entered into the following month's draw.
  3. MyMoto reserves the right to modify the submission method at any time with reasonable notice published on mymoto.com.au.

4. Video Guidelines

4.1 Content Requirements

Your Video Review must:

  1. be between 60 seconds and 5 minutes in duration;
  2. feature the vehicle you purchased through mymoto.com.au;
  3. include your genuine, personal opinions about the vehicle — covering what you love, like, find useful or wish was done differently;
  4. be filmed in a safe location (not while operating the vehicle);
  5. be filmed in good lighting with clear, audible sound; and
  6. be entirely your own original content.

4.2 Content Prohibited

Your Video Review must NOT contain:

  1. offensive, defamatory, discriminatory, hateful, threatening, or sexually explicit material;
  2. personal information of any third party without their explicit consent (including faces, voices, names, or addresses of individuals who have not consented to appear);
  3. children under the age of 18, unless accompanied by explicit written parental or guardian consent provided at the time of submission;
  4. copyrighted music, footage, images, or other third-party intellectual property, unless you hold the necessary licences;
  5. commercial advertising, sponsorship messaging, or promotional material for any third-party brand, product, or service;
  6. false, misleading, or deceptive statements about MyMoto, the vehicle, or any other person, MyMoto Partner Network or related entity;
  7. content that would be unlawful to publish in Australia; or
  8. footage filmed while you are operating the vehicle (including while stationary on a public road where it is unsafe to do so).

4.2 Technical Requirements

Videos should be submitted in a commonly accepted format (e.g. MP4, MOV). MyMoto may reject submissions that are of insufficient technical quality to be shared on its website or social media channels.

5. Review and Approval

  1. All Video Review submissions are subject to review and approval by MyMoto in its sole and absolute discretion.
  2. MyMoto may reject, remove, or decline to publish any submission that, in its assessment, does not comply with these Terms, does not meet the Video Guidelines, or is otherwise not suitable for resharing on MyMoto's website or social media platforms for any reason.
  3. Rejection of a submission does not automatically disqualify the entrant from the monthly draw, provided the submission was made in good faith and substantially complies with these Terms. MyMoto reserves the right to seek a revised submission where technically feasible.
  4. MyMoto will endeavour to review submissions within 7 business days of receipt. You will be notified upon successful submission or in the event that your submission requires amendment or has been rejected due to quality issues or if it does not comply with these Terms & Conditions.

6. Intellectual Property and Licence

  1. You retain ownership of the copyright in your Video Review.
  2. By submitting a Video Review, you grant MyMoto a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, reproduce, edit, adapt, publish, translate, distribute, and display your Video Review (in whole or in part) across any media, including but not limited to mymoto.com.au, social media platforms (including Instagram, Facebook, TikTok, YouTube, and LinkedIn), email marketing, digital advertising, and any other marketing or promotional materials.
  3. You warrant that:
    1. You are the sole author and owner of the Video Review or have all necessary rights and permissions to grant the above licence;
    2. The Video Review does not infringe the intellectual property rights, privacy rights, or any other rights of any third party; and
    3. You have obtained all necessary consents from any individuals who appear or are identifiable in the Video Review.
  4. MyMoto may credit you by your first name and the make/model of your vehicle when publishing your Video Review, but is under no obligation to do so.
  5. MyMoto may edit, crop, or otherwise adapt your Video Review for formatting or platform-specific requirements without altering the substantive content or misrepresenting your views.

7. Monthly Draw - Prize and Selection

  1. One (1) prize of AUD $300 gift card and Two (2) prizes of AUD $100 gift cards will be awarded each calendar month ('Monthly Prize').
  2. All eligible Video Review submissions received during a calendar month will be entered into that month's draw.
  3. The draw will be conducted by random selection from all eligible entries, by an independent person or automated process, on or before the 10th business day of the following month.
  4. The winners will be notified via the email address associated with their MyMoto account within 5 business days of the draw.
  5. If a winners cannot be contacted within 7 days of the draw notification, or declines the prize, MyMoto reserves the right to conduct a redraw.
  6. Prize payment gift card will be made via MyMoto’s chosen gift card platform provider within 21 days of the winner being confirmed and providing all required details.
  7. The prize is non-transferable and cannot be exchanged for any other product, service, or cash amount (except as stated in clause 7.1).
  8. MyMoto's decision in relation to all aspects of the draw is final and no correspondence will be entered into.

8. Privacy 

  1. By participating in the Program, you consent to MyMoto collecting, using, and disclosing your personal information for the purpose of administering the Program, conducting the draw, and (if you win) publishing your first name and general location on MyMoto's website and social media.
  2. Personal information collected in connection with the Program will be handled in accordance with MyMoto's Privacy Policy, available at mymoto.com.au/privacy.
  3. If you submit a Video Review that includes the personal information or likeness of any third party, you warrant that you have obtained all necessary consents for MyMoto to use that content in the manner described in Section 6.

9. Publicity

  1. By accepting a prize, the winner agrees to participate in reasonable promotional activities related to the Program, including having their first name, state of residence, and vehicle model published on MyMoto's website and social media, at no additional cost to MyMoto.
  2. Winners may opt out of publicity by notifying MyMoto in writing within 5 days of being notified of their win. Opting out will not affect entitlement to the prize.

10. Disqualification

MyMoto reserves the right to disqualify any entrant who:

  1. submits a Video Review that does not comply with these Terms or the Video Guidelines;
  2. makes a false or misleading declaration in connection with their entry;
  3. tampers with, or attempts to tamper with, the Program;
  4. engages in conduct that is harmful, abusive, or disruptive in connection with the Program; or
  5. is found to be ineligible under Section 2 at any time.

11. Limitation of Liability

  1. To the maximum extent permitted by Australian law, MyMoto excludes all liability for any loss or damage (including indirect, consequential, or incidental loss) arising from or in connection with your participation in the Program, the publication of your Video Review, or the award or use of any prize.
  2. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.
  3. MyMoto does not guarantee that submitted Video Reviews will be published and accepts no liability in connection with a decision not to publish a submission.
  4. MyMoto reserves the right to remove any published video and related content without notice.

12. Modification and Cancellation

  1. MyMoto reserves the right to remove any published video and related content without notice.
  2. MyMoto reserves the right to modify, suspend, or cancel the Program at any time with reasonable notice published on mymoto.com.au.
  3. In the event of cancellation, MyMoto will endeavour to conduct a final draw for all eligible submissions received up to the date of cancellation.

13. Governing Law

These Terms are governed by the laws of Western Australia, Australia. Any disputes arising from or in connection with the Program or these Terms will be subject to the non-exclusive jurisdiction of the courts of Western Australia.
